PNP statement on defamation lawsuit
In light of an action for defamation brought by a sitting member of the House of Assembly (HOA) against a private citizen and for which the Progressive National Party (the
We recognize that individuals in public positions are more susceptible to criticism compared to private citizens. However, we firmly believe in respecting the autonomy of our members and their right to defend themselves against defamation.
Additionally, we wholeheartedly support the principles of freedom of speech and expression for all.
In this regard, we align ourselves with Article 10 of the European Convention on Human Rights, which states that every individual has the rights to freedom of expression, including the freedom to hold opinions and gather and disseminate information and ideas. We firmly believe that exercising these rights without fear or unlawful interference is fundamental to living in an open and equitable society.
Freedom of speech and expression, however, is not absolute. There are some common limitations or boundaries to freedom of speech as it relates to libel, slander, and obscenity, and Article 10 further asserts that:
The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.
The Progressive National Party firmly upholds the importance of freedom of expression as enshrined in the Constitution and recognized by global watchdog bodies.
However, we are deeply troubled by the escalating lack of civility, vulgarity, and poor taste prevalent on electronic media platforms. We specifically condemn insensitivity and the lack of consideration for those who are grieving or experiencing tragedy, as well as the promotion of obscenity through electronic broadcasts, photography, videography, and text messages.
We appeal to all individuals engaged in electronic media to exercise their rights responsibly. We urge them to not only advocate for themselves and others but also to criticize and challenge governmental policies and the performance of politicians when deemed necessary. Moreover, we encourage them to utilize the official systems in place to defend their rights when they are violated.
We call upon everyone to refrain from engaging in hate speech and other forms of demeaning behavior or character assassination toward one another. Instead, let us strive to validate and affirm each other’s worth, even in instances where agreement is not reached.
Together, let us work towards a Turks and Caicos that upholds freedom of expression while promoting responsible behavior, respectful dialogue, and empathy towards others.
God bless you, and God bless our beautiful Turks and Caicos Islands.
